SKYEWORX Terms and Conditions

Before you dive into the legal details, here is the high-level summary of what these terms mean for you:

  • Service Purpose: SKYEWORX provides automated backup and restore services for Jira, JSM, and Confluence.

  • Data Ownership: You own your data. We simply provide the secure infrastructure and tools to protect and restore it.

  • Security: Access is secured via your Azure email login. You are responsible for maintaining the security of your credentials.

  • Procurement: Services purchased through the AWS Marketplace are subject to both SKYEWORX terms and AWS standard agreements.

  • Responsibility: While we provide the tools for recovery, you are responsible for defining your own backup frequencies and retention policies within the app.

Agreement to Terms

SKYEWORX provides a Software-as-a-Service (SaaS) platform designed to facilitate the backup and restoration of Atlassian Cloud products, including but not limited to:

  • SKYEWORX for Jira

  • SKYEWORX for Jira Service Management (JSM)

  • SKYEWORX for Confluence

Azure and Atlassian Integration

Users must utilize a valid Azure email to authenticate and connect their Atlassian environments to the SKYEWORX dashboard. SKYEWORX does not store your Azure passwords but utilizes secure authentication tokens to perform backup and restore operations as directed by the user.

Account Security and Data Management

As a user of SKYEWORX, you are responsible for:

  • Maintaining the confidentiality of your login credentials.

  • Ensuring that SKYEWORX has the appropriate permissions within your Atlassian site to perform backups.

  • Periodically reviewing your Backup Insights dashboard to confirm successful backup cycles.

  • Identifying and selecting the correct data for restoration during a point-in-time recovery event.

Ownership and Rights

The SKYEWORX platform, including its original content, features, and functionality (specifically our proprietary “Tree-Structure” restoration logic), remains the exclusive property of SKYEWORX and its licensors. Our trademarks and brand identity may not be used in connection with any product or service without prior written consent.

Standard SaaS Liability

In no event shall SKYEWORX, nor its directors, employees, or partners, be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service. While SKYEWORX strives for 100% data integrity, the user acknowledges that data recovery is dependent on the health of the source Atlassian APIs and the user’s configured backup settings.

AWS Marketplace Transactions

For users who procure SKYEWORX via the AWS Marketplace, billing and payment terms are governed by your existing AWS agreement. SKYEWORX reserves the right to modify subscription fees with prior notice, which will be reflected in your AWS billing cycle.

Service Discontinuation

We may terminate or suspend access to our service immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms. Upon termination, your right to use the SKYEWORX platform will cease immediately.

Legal Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which SKYEWORX is registered, without regard to its conflict of law provisions.
